Kojaycat Terms and Conditions of Sale – Rev 15 18/010/2017
The processing of your payment and acknowledgment of your order does not constitute legal acceptance of your order.
All orders placed by you and purchases of goods from us via our website are on the basis of these Terms and Conditions and are subject to acceptance by us by delivery of the goods to you; at which point a legally binding contract is constituted between us.
You are responsible for maintaining the confidentiality of your password and account and any activities that occur under your account. We will not be liable for any loss or damage which may arise as a result of any failure by you to protect your password or account.
We do not offer credit or account facilities for business or individuals
Kojaycat only accept Paypal, online debit/credit card, BACS and Postal Orders from UK Post Offices. We do not accept personal cheques
For international purchases we only accept Paypal payments. We do not accept International currency or money orders as payments.
All payments must be received in full before any items will be processed and sent. This includes all orders paid for using BACS payments which can take up to 36 hours to clear depending on the banks involved.
If the billing address is different from the delivery address and you are paying via Paypal then you must have the delivery address added to your paypal account. i.e. When the paypal payment comes through to us it must display the delivery address, not the billing address.
The address on the paypal payment will be the address that your order will be shipped too. This is to comply with paypal seller protection proceedures.
CHANGES TO ORDERS PLACED
If the order placed needs to be altered before processing then a £1.00 admin fee plus or minus price difference will be applied to the order. If the order has already been processed then no alterations can be accepted.
We may use the following services for postage: Royal Mail, Parcelforce courier to UK Mainland destinations. All items are posted with a signature required, no exceptions.
For orders over £75.00 either select Special Delivery or Parcelforce as the delivery method as orders over this amount isn't covered by Royal Mail standard postage method. We reserve the right to cancel and refund orders placed that doesn't have the correct postage method selected.
We reserve the right to either upgrade postage paid to a more secure postage method or the right to cancel and refund the order if the net value is over £50 or weight is over 2.5kg and the correct postage method hasn't been selected.
For areas with the following postcodes please select the correct delivery method as these postcodes can't receive the normal courier options

Isle of Man and Northern Ireland , please contact us for a postage quote before purchase. Failure to do so will result in your order being delayed or possibly being cancelled.
We sometimes offer reduced or free postage options, these offers are only available on orders placed online. Orders that are processed manually the postage offers do not apply and will be charged at normal rates.
We do not ship to the Channel Islands.
Certain other geographical areas can’t receive a next day delivery, please check with us before ordering. Examples are Scottish Highlands and Islands etc may be subject to a 48hr or more delivery.
The buyer will have a choice of postage services to use depending on the weight of the purchase. A drop down menu will appear at the checkout with the services available for the weight of item or items purchased.
If your order value is over £50 net (before vat and postage is added), the correct postage method must be selected or order may be cancelled, Parcelforce or Royal Mal Special Delivery for orders over £50 net. Royal Mail 1st and 2nd class only covers up to £50 if the package were to lost in the post.
Special Delivery option is automatically covered for up to 500.00 GBP if in the unlikely event that it is lost in the post.
We will not be responsible for the cost of the items if you have NOT selected the correct postage method when you made the purchase and the package is lost in the post. We will only supply you with a posting receipt to enable you to make a claim for the lost items.
If you are purchasing from the EU or outside of the EU some countries we will offer a fully tracked option on the checkout pages. We strongly recommend that you choose this option as your package will be tracked to your door. Not all countries offer this facility, but where it is please select this option. The Royal Mail International Signed for option is only tracked up to the point of departure in the UK, then a signature is required at the delivery address it is not a fully tracked service
If the courier option is chosen they will require a signature at the point of delivery. Please make sure that you or someone in the household is there to receive the package. We will email you the tracking details of your consignment and the carrier, it is your responsibility to check the tracking details if the package hasn't been delivered on the expected delivery date. Failing delivery, the driver will leave a card, with details to arrange a re-delivery or a pick up from the local depot. The courier company will only hold the package for 5 days, if you do not contact them or pick the package up from them they will return to parcel to us. This incurs costs charged to us directly by Parcelforce is £8.50 per parcel plus vat which will be payable by the customer before the parcel will be resent. A further resending postage charge will also be applied
Parcelforce can redeliver your parcel to a local post office if you are not in. They will charge you a nominal fee for this service if required.
We do not guarantee a next day delivery. It is the responsibility of the carrier to try and deliver the next working day, however, it can be delayed by several days due to severe weather conditions or road closures.
If you don’t want us to post your package by courier then please contact us directly before you make any payments for a postage cost as this will be more due to Royal Mail prices being more expensive.
Kojaycat will send a confirmation email to notify you of your items dispatch. We aim to post your item within 24hrs of receipt of cleared payment. Please check your message inbox if you haven’t received your item.
Kojaycat only post on weekdays Monday – Friday. If your order is received after 1.00pm on a Friday then it may not be processed until the following Monday.
We do not post over Bank Holiday weekends. If you buy an item over a bank holiday weekend then your item will not be posted until the first working day after (Tuesday).
All of our packets and boxes are posted on a "Signed For" delivery. Do not add notes about leaving the parcel "in the box next to the door" or "in the blue bin if nobody home" as these will be ignored. Parcels will only be delivered when there is somebody at the address to sign for it.
For items sent by Royal Mail that have not been received please contact us directly through email. Check with your local sorting office first before contacting us as it may be that Royal Mail have failed to leave a card indicating that they tried to deliver. Royal Mail does not class UK postage missing until 15 working days after the posting date and 25 days for International post. If the item is returned to us then a further postage charge will be applied for the item is re posted.
It is the buyer’s responsibility to ensure that the correct delivery address is supplied to Kojaycat. Any costs incurred due to delivery error to an incorrect address will be passed to the buyer before re-delivery to the correct address.
Goods must be inspected on delivery and any claims of shortage must be reported to email@example.com within 48 hours of delivery. Any claims reported after this period will not be considered.
SPECIAL ORDER ITEMS
For special order items I.E. tracer cables or longer length cables: If these are ordered with other stock items then we will ship the order complete when we have the item in stock. If you require a part despatch of the stocked items then a postage charge will be made for sending the special order parts.
Any parts that are ordered as a "Special Order " (when we have to get non stocked parts specially made like tracer reels of cable) these sales are final, and cannot be cancelled by the customer. There will be no returns accepted or credit notes issued on these items.
We offer a 14 day return service. If you are unhappy with your purchase please contact us in writing ( email will suffice) that you wish to cancel the contract within 14 days and we will issue you with a returns number. The customer is responsible for all return postage costs.
No returns accepted on parts that we have had to get specially manufactured as this is a bespoke service and not covered under the distance selling regulations.
We will then inspect the goods and if they are unused and in original packaging then we will issue a full refund.
Industrial disputes by Royal Mail staff will delay deliveries. We are not responsible for any delays once your purchase has been passed to Royal Mail or any courier that we may use
We reserve the right to cancel and refund any order if any of the above terms and conditions aren't met by the buyer.
If you are unhappy with your purchase please inform us in writing with-in 14 days of receipt for a returns number. If you are returning you are liable for the postage costs, this will be at the buyers expense.
To qualify for a return you must meet the following conditions.
You contact us in writing with-in 14 days of receipt for a returns number.
The item or items are in the original packaging and in a unused condition.
The item or items are returned to us using recorded signed for delivery as we will not issue refunds on items lost in the post if you are returning it to us.
All of our cable reels are weighed before dispatch, on return the cable reel must be the same weight on return and still be factory sealed.
VALUE ADDED TAX
We are a UK VAT registered company. We charge VAT on purchases made from the United KIngdom and member countries of the European Union at the current rate of 20% from 04/01/2011
If you are a VAT registered EU business outside of the UK please contact us prior to opening an account or making any purchases. We reserve the right to cancel and refund any orders that has been placed without prior contact being made regarding registering an account on our website with an EU Vat number. Your VAT details will be checked on the VIES, we will only ship to the business address registered for VAT.
For purchases made from outside of the European Union VAT is not payable.
Any defective parts must be returned for inspection before a refund or replacement (If in stock) will be issued. Contact us before sending any parts back for replacement for a returns number.
If a part returned has been deemed to have been damaged due to incorrect installation or has been used for competition purposes then no refund or replacement will be issued.
If you purchase goods from us as a consumer (which means anyone who acts outside the course of their business, trade or profession), to the extent not prohibited by law, we accept no liability for any:
Loss which is not foreseeable (loss is foreseeable if it was an obvious consequence of our breach or if it was contemplated by you and us at the time you and we entered into our contract);
Loss which arises when we are not at fault or in breach of these Terms and Conditions; and
Business loss (which includes loss of profits, loss of business, contracts, goodwill, business opportunity and other similar losses, as well as business interruption).
If you are a trade customer, we shall have no liability to compensate you (whether in contract, tort (including negligence), breach of statutory duty or otherwise), other than any refund we make under these Terms and Conditions or otherwise at our discretion.
If you are a trade customer, we shall not be liable to you (whether in contract, tort (including negligence), breach of statutory duty or otherwise) for any: 1/ loss of profits, business, contracts, goodwill, business opportunity and other similar losses, or any business interruption; or (ii) indirect or consequential loss, neither will we be liable to you for any other loss which is not a foreseeable consequence of us being in breach of these Terms and Conditions or our legal duties.
If you are a trade customer, you acknowledge and agree that these Terms and Conditions constitute the entire and only agreement between us.
Nothing in these Terms and Conditions is intended to affect your legal rights if you are a consumer, nor is it intended to exclude or limit our liability to you for fraud, fraudulent misrepresentation, for death or personal injury resulting from our negligence or for any other liability which cannot be limited or excluded as a matter of applicable law>
Goods are intended for use in the UK only and we cannot confirm that the goods comply with any laws, regulations or other standards applicable outside the UK. All goods are sold in accordance with the manufacturers specifications and are subject to any qualifications, representations or instructions contained in the documentation associated with the goods.
If you are a trade customer, we will not be responsible to you or, in the event that you are undertaking work for another person, to any other person, for the use or installation of any goods by you. Accordingly, if you are a trade customer, you hereby agree to hold us harmless from and indemnify us against any liability associated with, any claim or allegation that we are responsible for any failings in the installation or use of goods that we supply.
ABUSE and FOUL LANGUAGE POLICY
We will not tollerate verbal or written abuse. Any customer who is abusive to any Kojaycat staff will have their accounts suspended and all further communication will cease as it is an offence under the Communications Act 2003 Section 127 to send an electronic message that is grossly offensive or of an indecent, obscene or menacing character.
We will do everything in our power to resolve and issues that you may have, but all communication will cease if any form of verbal or written abuse is received.
This is a bespoke service and once the cable has been cut then no returns, exchanges or order cancellations will be accepted.
Cut & Custom made cables is not covered under the distance selling regulations
Kojaycat only sell full cable reels or cable cut lengths suitable for Automotive purposes and some Marine applications. NONE of the parts supplied are suitable for any aeronautical purposes.
It is the responsibility of the buyer to ensure that parts purchased are fit for the use intended.
We do not supply cable for Aeronautical or Aerospace applications, all of our cable is manufactured and sourced from other companies for automotive and marine purposes only.
It is the responsibility of the user to ensure that the materials chosen are suitable for the application to which they are put. No liability is accepted for their application.
We do not offer advice on materials to use for a particular application
COLOUR WIRING DIAGRAMS
Kojaycat own all copyright and intellectual property rights of all of our colour wiring diagrams.
The diagram or any part of the diagram purchased from us may not be reproduced, electronically stored or transmitted in any form without our express permission.
Kojaycat try to make sure that all of our diagrams are as accurate as possible. They are designed to be used in conjunction with a black and white factory wiring diagram, therefore we accept no responsibility for any damage caused or sustained by incorrect wiring by the machine owner or designated mechanic.
We accept no responsibility for any mistakes, omissions or errors made when drawing the diagram,
These drawings are for reference only and are designed to be used as an aid to help identify the cable colours and routes from a Black & White factory wiring diagram.
OUT OF STOCK PARTS
Kojaycat keep a stock of all of our parts that we sell. In the unlikely event that you order an item that we don’t have in stock we will contact you to let you know. We will either put the item on back order or we will offer you a full refund.
